Many attorneys and their clients are completely unaware of the option of using a private judge. They presume that their divorce or civil matter will be bogged down in a court system clogged with overloaded dockets. The "waiting game" does little to help an already emotional and costly situation.
With court dockets constantly overloaded, the prospect for an immediate trial is nearly impossible. A difficult situation is made worse during this "waiting game." While little can be done to speed up the formal legal process, Texas residents have another option. Matters that can be heard by a private judge include discovery disputes, temporary orders, temporary injunctions and final trials. The only difference between private judging and its public counterpart is the inability to have a jury trial. The first step is filing a motion in court to retain a specific judge. Once that order is signed, we schedule a trial date and location and notify the court of the case.
During the trial, both sides present their respective cases. Once the private judge makes a decision, that rule is binding and enforceable. Appeals can be made, but only in Texas appellate court.
